These terms and conditions (“Agreement or Terms of Use”) governs your use of [insert website handle], including all webpages, applications, content, goods, services, features and functions provided or offered on or through this website (collectively, the “Site“), and is by and between Food Matters India Private Limited (collectively “Food Matters”, “we” or “our”) and you (“You“). By viewing, accessing, engaging in transactions of any kind (including but not limited to making reservations, booking events, purchasing retail products), and/or in any other manner utilizing this Site (collectively as “Use”), you hereby agree to the terms set forth herein, and in the Food Matters’ Privacy Policy.

Please note that additional terms and conditions may apply to making reservations, booking events, engaging in purchases or other transactions or activities on or through this Site. You agree to comply with the terms and conditions set forth herein and any and all such applicable additional terms and conditions, per the Use.

 

ELIGIBILITY

This Site is only to be used for your personal non-commercial use and information. As a condition of your Use of the Site: (i) you must be at least 18 years of age; (ii) you must possess the legal authority and capacity to create a binding legal obligation, including to be bound by the terms of this Agreement; and (iii) your Use of the Site must not violate any law, statute, ordinance, rule or regulation. You hereby represent and warrant that you satisfy all of the foregoing conditions. 

 

WHEN PERSONAL INFORMATION COLLECTED

Food Matters will collect personal information from you, which includes your first and last name, address, telephone and mobile number, email address, payment details, or any other information, when you knowingly provide us with this information. This will generally occur when you:

  1. enter into a competition or participate in a promotion
  2. participate in a survey
  3. subscribe to our mailing list
  4. apply for a job
  5. submit feedback or request a call back
  6. post a query
  7. contact our reservation desk or customer service team

We use your personal information only for promotions of our services. You could opt out by sending an email to [Add Email], with your name and mobile number. 

 

INTELLECTUAL PROPERTY RIGHTS

This Site displays or references valuable trademarks, logos and service marks owned by Food Matters, including but not limited to (The Table, Mag St. Cafe, Mag St. Bread Co, Magazine St. Kitchen, Mag St. Toppings, Miss T, Iktara, The Table Farm) and all related products/services and service names, design marks and slogans, used by Food Matters to distinguish its services and wares (collectively, the “Marks”). 

No trademark or service mark license is granted in connection with the products/services contained on this Site. Access to this Site does not authorize anyone to use any Marks in any manner. Marks displayed on this Site, whether registered or unregistered, of Food Matters or others, are the intellectual property of their respective owners, and Food Matters shall not be held liable in any manner whatsoever for any unlawful, unauthorized use of the Marks.

Food Matters expressly and exclusively reserves all the intellectual property rights in all text, programs, products/services, processes, technology, content, software and other materials, which appear on this Site, including its looks and feel. The compilation (meaning the collection, arrangement and assembly) of the content on the Site is the exclusive property of Food Matters and is protected by the Indian copyright laws and international treaties. Consequently, the materials on this Site shall not be copied, reproduced, duplicated, republished, downloaded, posted, transmitted, distributed or modified in whole or in part or in any other form whatsoever, except for your personal, non-commercial use only. 

All contents of the website, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, is the property of Food matters, and the same is protected under intellectual property rights, and applicable laws of India. Any duplication, reutilization, reuse, cloning of contents of this website or any part thereof without prior written consent of Food Matters shall lead to infringement of Intellectual property rights and the same may attract cause of action against such user of the content in accordance with the applicable laws of India.

 

PRICING INFORMATION

Food Matters strives to provide accurate products/services and pricing information, however, errors may occur from time to time. The prices and availability of the products and services provided by Food Matters or offered on the Site, are subject to change without prior notice and at the sole discretion of Food Matters. 

 

CANCELLATIONS, RETURNS AND REFUNDS

Except as expressly provided for and permitted in these Terms of Use, no refunds for any cancellations or returns will be processed by Food Matters. Once purchased, or booked, no products or services may be refunded to the user, for any reason. 

If the user registers, purchases or avails any products or services, offered by Food Matters on the Site, which is confirmed by Food Matters, but, unavailable due to any unforeseen or unexpected circumstances, such request of the user will be canceled, and the payment amount pertaining to the unavailable product and/or service will be refunded either to the user’s source account, or by way of a credit voucher, at the sole discretion of Food Matters, without any interest, and without any additional liability on Food Matters. 

 

VOUCHERS AND GIFT CARD POLICY

Gift Cards or Credit Vouchers (“GV”), issued by the Food Matters may be used by you at any of the Food Matters’ outlets, for Food Matters’ events and/or for ordering directly through Food Matter’s delivery brand. 

GV shall be valid as per the validity mentioned, if nothing is mentioned, the validity shall be 1 month from the date of issue. Prior intimation for events and offline deliveries and prior reservation for tables at the outlets are advised. Please present the original GV to your manager or server at the time of placing the order. The GV cannot be clubbed with any other existing offer or discount. Taxes on the total billing will be applicable as usual. Food Matters will not, in part of full, provide cash payment, or refund against any gift voucher issued. 

The management reserves the right to identify the authenticity of the GV in case of any dispute. Once expired, the credits in the GV lapse, and Food Matters shall not be liable to extend the validity, under any circumstances. Food Matters does not accept any liability if you lose the copy of the voucher. 

 

GOVERNING LAW AND JURISDICTION

These Terms of Use shall be construed in accordance with the applicable laws of India. In the event of any dispute, difference or claim arising out of these Terms of Use, the same shall be settled in accordance with the Laws of India through regular judicial process and the courts of Mumbai, India shall have exclusive jurisdiction.

 

FORCE MAJEURE

Neither party shall be liable to the other for any failure to perform any obligation under this Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, COVID-19, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality outside of our control, epidemic or pandemic which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any party affected by such event shall forthwith inform the other party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any Agreement contained herein.

 

ENTIRE AGREEMENT

These Terms of Use, together with Privacy Policy [Link here], and additional terms and conditions which apply to making reservations and/or booking events, and/or engaging in purchases and/or other transactions or activities on or through this Site, constitute the entire agreement between you and Food Matters.

 

DISPUTE RESOLUTION

In the event of any dispute, difference or claim arising out of this Privacy Policy the same shall be settled in accordance with the Laws of India through regular judicial process and the courts of Mumbai, India shall have exclusive jurisdiction.

DISCLAIMER

In no event will the Company be liable to you or to any other party for any indirect, special, consequential or punitive damages for or arising from any use of, or access to, the personal information or any data submitted on our websites or any other or hyper linked website.

NOTIFICATION OF CHANGES

By accessing our Website, you agree to these Terms of Use. We keep our Terms of Use under regular review to make sure it is up to date and accurate.
